Terms of Service

These Terms govern your use of the Delark email delivery platform, operated by Peicloud Digital, S.L.(the "Service"). By using the Service you agree to these Terms.

1. Accounts

You are responsible for your account, credentials, and all activity under it. You must provide accurate information and keep it current.

2. Acceptable use

• No unsolicited bulk email (spam). You must have consent to email your recipients.
• No phishing, malware, fraudulent, or illegal content.
• Honor unsubscribe requests and applicable anti-spam laws (CAN-SPAM, GDPR, CASL, etc.).
• No attempts to bypass sending limits, sender authentication, or platform security.

We may throttle, suspend, or terminate sending that harms deliverability, violates these Terms, or triggers abuse signals (high bounce/complaint rates, blocklistings).

3. Plans, billing & quotas

Paid plans are billed in advance and are non-refundable except where required by law. Sending is subject to your plan's monthly limits; overages and add-ons are billed per your plan.

4. Customer content

You retain ownership of your content and contact data. You grant us the rights necessary to operate the Service. You are responsible for the legality of your content and your recipients' consent.

5. Service availability

We aim for high availability but the Service is provided "as is" without warranty. Scheduled maintenance and third-party dependencies may affect availability.

6. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

7. Termination

You may cancel at any time. We may suspend or terminate for breach of these Terms. On termination, your data is deleted per our retention policy.

8. Changes

We may update these Terms; material changes will be notified in advance.
